Steven Swann v. Patrons Oxford Insurance Company
Hearing #2005-15886, Decision Issued April 21, 2005.

The insured requested a hearing following receipt of a notice of automobile insurance coverage cancellation citing a driver’s license suspension. At hearing, the company presented the insured’s motor vehicle records. The insured acknowledged the suspension but questioned the company’s motive in issuing the cancellation notice.

Held: For the company. The company demonstrated that the insured’s Maine driver’s license was suspended during the policy term. The suspension imposed does not meet any of the 3 exceptions articulated in the statute. Therefore, the suspension may provide grounds cancellation of the policy under 24-A M.R.S.A. § 2914(4).
