Bulletin 188
Court mandated substance abuse treatment |
May 28, 1991
The Bureau has received several complaints concerning denial of claims for substance abuse treatment on the grounds that the treatment was mandated by a court. Title 24 M.R.S.A. Section 2329 and Title 24-A M.R.S.A. Section 2842 mandate coverage of treatment for alcoholism and drug dependency. Rule Chapter 320 establishes minimum standards for these benefits. No exception for court mandated treatment is permitted. Services which would otherwise be covered may not be excluded based solely on court mandation.
