ADVISORY RULING #5
JANUARY 27, 1975
(Formerly Administrative
Interpretation #6)
January 27, 1975
Dear
You have inquired whether the sale of navigational equipment to a sole proprietor Maine fisherman is a "Consumer Credit" sale, in view of Section 1-301, subsection 4, defining "agricultural purpose."
It is the opinion of this Office that the typical Maine fisherman neither cultivates, plants, proprogates, nor nurtures, to any substantial degree, the fish population along the Maine coast. It would, therefore, appear that the situation which you have described would not fall within the definition of "agricultural purpose," and would not be considered a "Consumer Credit" sale where the fisherman was utilizing this navigational equipment for a business operation.
Respectfully,
John E. Quinn
Superintendent
