Amalfitano, Albert R., D.O. (#1752, Waterville, ME) - 1990 Consent Agreement regarding Dr. Amalfitano's practice of medicine. The Agreement was terminated in 1995.

Amalfitano, Albert R., D.O. - 1998 Consent Agreement regarding improper prescribing procedures. This agreement was amended in September 1998 to include a letter of warning.

Amalfitano, Albert R., D.O. – September 1998 Amendment to Consent Agreement requiring 1) that the licensee take the SPEX examination upon completion of a remediation course; 2) 10 patient charts reviewed by a physician reviewer in the same practice specialty; 3) letter of warning (as noted above); 4) referral of patients with addictions to a detox program and/or referred to a new physician, pain clinic or emergency room. If patients not accepted or refuse referral, it is the responsibility of the licensee to develop a titration plan.

Bertuch, Inna M., D.O. a/k/a Inna M. LaBelle, D.O. - (#1790, Atlanta, GA) - December 2009 - Consent Agreement and Board Order regarding unprofessional conduct. Licensee must practice in a setting approved by the Board; must have a monitoring physician (who will review no less than 10 charts per month), licensed and working in the operating room, preferably an anesthesiologist; must abstain from the use of any and all mood or mind altering substances whether illicit or not; must not self-prescribe. Licensee must contract with the Maine Physicians Health Program for substance monitoring; may take only medications prescribed for her by her primary care physician and other health professionals. Licensee must receive treatment from qualified professionals to address substance abuse and depression; must attend AA/Peer Support meetings and must provide a full copy of the Agreement and any subsequent amendments to it, to the Chief of Staff at any institution(s) where she holds privileges or is employed, to her monitoring physician and to each treatment professional previously identified. Licensee will pay costs incurred in connection with the Board's investigation. Term of Agreement: Board will review terms in 3 years, December 2012.

Morin, Kristzina, D.O. (#960, Machias, ME) – October 2010 Consent Agreement & Board Order including a Warning cautioning the licensee to be more sensitive when dealing with patients who may be experiencing chronic pain from a serious or terminal illness, such as cancer. Additionally, within 6 months, the licensee must complete continuing medical education on the subject of managing patients with cancer pain and/or sensitivity to patients dealing with a malignancy. The Consent Agreement will terminate upon Board determination that all conditions have been satisfactorily met.

Owens, James (#1434, Portland, ME) July 2006 Consent Agreement regarding prescribing practices. Reprimand issued. 29-day license suspension starting September 13, 2006. Practice restrictions regarding work hours and setting. Monthly chart reviews by monitoring physician w/monthly reports to Board. Prescribing restricted to as allowed by guidelines contained in Chapters 11 & 16 of the Rules adopted by the Board. Agreement requires continuing medical education regarding ethics & professional boundaries; monthly meetings with mental health professional w/report to Board; quarterly visits to primary care provider with quarterly reports to the Board; monthly meeting with physician providing treatment for sleep disorder with semi-annual reports to the Board; reevaluation one year after resumption of practice with report to Board; payment of costs. Term: automatic review regarding necessity of Consent Agreement once it has been in effect for 3 years.

Owens, James (#1434, Portland, ME) - May 2007 - First Amendment to Consent Agreement - Practice restrictions amended to provide more flexibility in obtaining employment as well as suspension of certain conditions while he is working overseas with Doctors Without Borders. Monitor requirement amended to allow other than Department Medical Director to monitor practice, if approved by Case Reporter or Board. Other terms of the original Consent Agreement remain in place.

Owens, James (#1434, Portland, ME) – October 2007 – Second Amendment requires attendance at an educational program approved by the Board regarding issues related to ethics and professional boundaries.

Owens, James (#1434, Portland, ME) – October 2008 – Third Amendment allows practice with/monitoring by Louis Hanson, D.O. during the hours of 6 a.m. and 12:00 p.m. and review of no less than 30 charts per month OR no less than 5 charts if working less than six (6) shifts per month and a report to the Board, due the first day of each month for twelve (12) months.

Owens, James (#1434, Portland, ME) – July 6, 2010 – Fifth Amendment to Consent Agreement and Board Order of July 2006. Practice Restrictions: specific day shift hours at a practice approved by the Board. No less than 30 charts per month to be reviewed by approved monitoring physician with reports (content specific) to the Board on a monthly basis, beginning on the first day of the month following the licensee’s first full month of practice. Licensee must follow an evaluation scheme modeled on the American Board of Internal Medicine’s ‘Evaluating Critical Competence in Internal Medicine’ which includes the utilization of the Mini-Clinical Evaluation Exercises and “Competencies at a Glance” card. Reporting requirement may be terminated after 6 months if no concerns have been reported to the Board. All other terms and conditions remain in place.

Owens, James, D.O. (#1434, Portland, ME) - July 2006 Consent Agreement & Board Order terminated effective December 9, 2010. Licensee complied with all terms of the Agreement.

Painter, Stanley, D.O. (#808, Winthrop, ME) - 2003 Consent Agreement regarding prescribing of Schedule II drugs.

Painter, Stanley, D. O. – November 2004 Second Amendment to Consent Agreement requires continuing medical education related to the contents, organization and maintenance of medical records.

Painter, Stanley, D. O. – 3rd Amendment to Consent Agreement. Effective 1/1/06, licensee shall not prescribe Sch. III drugs to patients, except those with 1) legitimate and documented pain from a dx of terminal cancer and, 2) those with a documented situation of acute pain for which the prescription can be for no more than a 30 day supply, no subsequent Sch. III prescriptions may be written. Licensee must assist those currently receiving prescriptions for Sch. III drugs to transfer prescribing to another physician or taper the patient off of the Sch. III medication.

Painter, Stanley, D.O. (#808, Winthrop) – October 2006 – Decision and Order regarding failure to comply with certain terms of his November 2004 Amendment to Consent Agreement. Licensee must reimburse the Board for the costs of the adjudicatory hearing. Licensee and his staff shall summarize the office practice regarding charting and recordkeeping.

Painter, Stanley, D.O. (#808, Winthrop, ME) - December 12, 2011 License suspended for 30 days (beginning 12/12/2011) pursuant to 5 M.R.S. Section 10004(3). - December 12, 2011 Board Order Update effective 1/9/12 – License suspension continued to 2/9/12.

Paolini, Charlotte, A., D.O. (#1350, Florida) - 1997 Consent Agreement regarding physician/patient boundary issues. The Consent Agreement was terminated in 1999.

Patnaude, Michael, D.O. – (#1568, Portland) – November 18, 2010 Board Order with sanctions following an adjudicatory hearing after which the Board found violations of 32 MRS§2591-A(2)(F), 32 MRS§2591-A(2)(E)(1), 32 MRS§2591-A(2)(H). Sanctions include required attendance at /completion of a professional boundaries and boundary violations course; licensee must undergo a neuropsychological evaluation with a full report to the Board; presentation before the Board explaining the boundaries course and what he gained from attendance. Licensee must also reimburse the Board for hearing costs.

Patnaude, Michael, D.O. – (#1568, Portland) – April 14, 2011 Final Decision & Order with sanctions following an adjudicatory (in October 2010). Licensee complied with the terms of the Interlocutory Decision & Order and following a presentation to the Board, pursuant to the Interlocutory Decision & Order, the Board ordered counseling for six (6) months on a monthly basis (with reports to the Board) to ensure maintenance of the progress made to date. The licensee was also ordered to reimburse the Board for hearing costs over and above those incurred as a result of the October 2010 hearing.

Perakis, Charles R., D.O. (#881, Scarborough, ME) - 1994 Consent Agreement regarding substance abuse.
