SERC Proposed Rules Change Available for Review

Registration Fee Payment Deadline Would ChangeThe State Emergency Response Commission (SERC) has proposed a rules change, moving the payment of the Registration Fee, now paid annually by Chemical Inventory filers on October 1, to March 1 of the following year. This change does not reduce or increase fees, but will make all Chemical Inventory reports and associated fees due on the same day. All reports and fees will be due March 1, for the previous calendar year. Because the fee dates were established by State rule-making, a formal review process including a public comment period is necessary to change the fee submission date. Information on the proposed rules amendment may be found on the Secretary of State's web site. A legal notice of the proposed rule change will also be published in newspapers statewide on June 10. The comment period on the proposed change is open through July 15, 2009. All comments on the proposed change or requests for additional information should be directed to Robert Gardner at MEMA, roberr.s.gardner@maine.gov or 207-624-4440. By federal and state law, chemical inventory reports are submitted by businesses and other agencies which maintain inventories of hazardous materials above levels set by the federal government. Associated fees are authorized by State law; fee amounts and submission schedule are established by rule.
