Rules, Regulations, and Policies Concerning
Highway Opening Permits State Agency Addendum
Upon written notice from the Department of Environmental Protection; Department of Human Services, Drinking Water Program; Department of Economic and Community Development; or USDA, Rural Development (“Funding Agencies”) that a project is funded, in whole or in part, by them, and subject to their control and approval, the following shall be required:
I. All of the MaineDOT’s Rules, Regulations and Policies for Highway Opening Permits shall apply except that when a Special Opening Permit is required, the applicant shall submit the calculated permit fee (10% of the Impact Value) with the application in lieu of establishing an escrow as specified in section II.E. Following completion of the project, the fee will be recalculated to reflect the actual impacted area and any adjustments for required MaineDOT inspection (see Paragraph V).
II. The Agency’s contract documents shall contain a requirement that a pre-construction video survey of the roadway work area be completed and submitted to the MaineDOT before work commences.
III. The Agency’s contract documents shall contain a requirement that all work must be to the satisfaction of MaineDOT following a final inspection by MaineDOT representatives before final payment is made by the Agency.
IV. All of the requirements dealing with roadway rehabilitation and traffic control contained in the MaineDOT’s Rules, Regulations and Policies, and Special Opening Permit shall be incorporated in the applicant’s bid documents.
V. The Agency shall be responsible for ensuring that the owner provides inspection to make certain that the work is done in conformance with the provisions of the Special Opening Permit and conforms to the latest revision of MaineDOT Standard Specifications for Highways and Bridges. This inspection may be in the form of direct Agency supervision or through the services of a resident project representative working under the supervision of a Professional Engineer. If the MaineDOT determines that the inspection of the work in the roadway is inadequate, MaineDOT may provide inspection to protect its infrastructure in accordance with its Rules, Regulations and Policies, and Special Opening Permit. The cost of this inspection will be added to the 10% portion of the final calculated permit fee.
VI. All roadway rehabilitation work shall be guaranteed for one full year from substantial completion of the project. Any corrective measures necessary during this warranty period shall be the responsibility of the permittee.
VII. The fee will be refunded in the event that an overlay is completed by the permittee, consisting of hot bituminous pavement, the entire paved roadway width, after the installation has undergone at least one winter season and within 1 calendar year of project completion. This overlay shall consist of ¾” minimum thickness hot bituminous pavement surface mixture, MaineDOT 2003 Standard Specifications HMA 9.5mm fine. Shimming before overlay may be required depending on the condition of the surface to be paved.
