Subject: Chemical Hygiene Officer

Purpose: Who can be appointed as the Chemical Hygiene Officer?

The Chemical Hygiene Officer in an educational facility shall be an actual employee of the educational facility system. An educational facility cannot appoint a private consultant as their Chemical Hygiene Officer. M.R.S.A. Title 26 Ch. 6 §563 defines an employee as “any person, including a minor whether lawfully or unlawfully employed, who is employed or permitted to work by the State, a state agency, county, municipal corporation, educational facility district or other public corporation or political subdivision.”

A private consultant can be used as a technical liaison to assist the educational facility and their chemical hygiene officer in the development, proper implementation, and provide training on the elements of their chemical hygiene programs.
