Case Title: "Parents v. RSU #51"

Parents challenged the district’s decision to remove the student from his private school and place him in a day treatment program.  Parents also wanted transportation expressly included in the IEP (although the district had been providing transportation, it was not stated in the IEP), and contended that transportation needed to be consistent and designed to bring the student to school on time.  The parents further insisted that the IEP include a behavior plan.  The district changed its mind about placement during the hearing, rendering the issue moot.  The Hearing Officer decided that the student’s IEP must be amended to provide for a mode of transportation that would allow the student to arrive at school on time without causing him undue anxiety, and to include a behavior plan.  The district had argued that the behavior plan was unnecessary because the student had been successful in the private school program, but the Hearing Officer found that this success was due in part to the behavioral supports built in to the student’s program.

The student, for whom an IEP had been developed, was removed from school and parentally placed in a private school.  Shortly after the IEP had expired, the parents re-enrolled the student, but the student received no special education services until two years later, despite evidence that the student was struggling with attentional and academic issues.  Based on these facts, the Hearing Officer found that the district violated its child find obligations and ordered tuition reimbursement.  The Hearing Officer rejected the parents’ claim that the IEP, when ultimately developed, was not appropriate.
