DHHS Emergency Rule Change: Emergency Interventions and Behavioral Treatment for People with Mental Retardation and/or Autism

Effective November 8, 2012, The Department of Health and Human Services adopts an emergency rule change to 14-197 C.M.R. Ch. 5, Regulations Governing Emergency Interventions and Behavioral Treatment for People with Mental Retardation and/or Autism. This rule and the authorizing statute, 34-B M.R.S. 5605(13)(B), require a three-person review team approve any behavior modification, behavior management, and safety device plans for an adult with an intellectual disability by unanimous decision. This emergency rule allows the three-person review team to approve behavior modification, behavior management and safety device plans for adults with an intellectual disability by majority decision.
