Procedures for requesting Child Protective Records Research

Enclosed are some formats we will be using:

1. Agency Registration Form (BCFSCP O-81) - (Word, PDF)*  We need this information to clearly identify agencies making these requests and to assure confidentiality of any information we disclose.

2. Client Authorization for Child Protective Records Research (BCFSCP O-82) - (Word, PDF)*  Initial Release Form.  This standard release form allows us to do the records research.  Only DHHS forms are allowed; do not put these forms on your letterhead or stationary.  This form must be photocopied for future use.

3. Findings Regarding Records Check (BCFSCP O-83) - (Word, PDF)* Subject to the limitations noted in the response letter, we will report findings of the child protective records research to the inquiring agency.  This form must be photocopied for future use and accompany the Initial Release form (BCFSCP O-82 along with a self addressed, stamped envelope for the response.

4. Client Authorization for Release of Case Record Information (BCFSCP O-84) - (Word, PDF)* Secondary Release Form.  If the records research shows the client was involved in a substantiated child protective case, we will need this release to disclose to the inquiring agency the nature of the client’s involvement in the child protective case, including any statement the client may have made about actions taken to deal with the problems.  This form must be photocopied for future use.

5. Findings Regarding Substantiated Case  (BCFSCP O-85)  - (Word, PDF)* The fact that an applicant has been involved in a substantiated case should not be used as the sole reason to disqualify the applicant.  The nature of the problems in the case, the use of resources, and the outcome should also be considered; this is the Department’s policy regarding applicants for child care licenses issued by the Department who have been involved in a child protective case.

Our office will not keep a record of performing the initial child protection background check.  It is the agency’s sole responsibility to maintain the record.

Requests for record research must be accompanied by a fee of $15.00 per person as authorized by P.L. 2003, C. 673, Part W.
