Minutes of June 5, 2007 Meeting

Call to Order:

 

Meeting was called to order at 9:05 AM.

 

Approval of May 1, 2007 meeting minutes:

 

Ike Goodwin made a motion to approve the May 1, 2007 minutes with one change to the Cecil Fogg vs Knowlton W.D. case which corrects a reference to an order that was actually a recommendation concerning the placement of a bottom seal.  Marc Loiselle seconded the motion. Passed.

 

Up Date on Sheriff:

 

Contract has been approved by DHHS, all signatures are final as of 5/21/2007.

 

Update on Appeals:

 

Wells Unlimited - Doug Wright: The Commission has not received a notice from the hearing officer as of this date.  The appeal is still pending.

 

Rachel Charette vs Kevin Levesque Well Drilling: An appeal between the two parties is still in the Superior Court process.  Mr. Levesque’s driller’s license may be renewed pending the appeal.

 

Update on Complaints:

 

Douglas & Brenda Adams vs Bill Knowlton Well Drilling:  On Hold pending confirmation that the old well has been properly abandoned.  Carol will call for confirmation.      

 

Don Fries vs Woodsome Well Drilling:  The corrective action has been partially completed - a new well has been completed and hooked up and one of the first two wells drilled has been abandoned. Dean Getchell will inspect after the 19th of June.

 

The ground needs to dry up some in order to complete the corrective action by properly abandoning the remaining unused well.  Dean Getchell will be present for the abandonment.  

 

Cheryl Oldfield vs Gary Adams Well Drilling:  Dean Getchell presented his inspection report which indicated that the old wells have not all been properly abandoned.   Two wells need to be abandoned.  Dean Getchell will be present for the abandonment and will take a water test.

 

     A new well was drilled for Ms. Oldfield by Innis Well Drilling. 

 

Findings: Marc Loiselle made a motion that a violation of Rule 300.1 had occurred. Well information forms need to be sent to the State (MGS) within 30 days of completion.  Forms were not submitted for the two wells drilled. Don Robbins 2nd the motion.  Passed.  Two (2) points assessed.  Marc Loiselle made a motion that the points are part of the original case and the fine will be waived – points will stay.  Don Robbins 2nd the motion.  Passed

 

Cecil Fogg vs Bill Knowlton Well Drilling: The water test taken by Dean Getchell has been received.  The driller had 60 days to complete corrective action.  On hold

 

Douglas BelfourMerl “Sam” Dunham Well Drilling:  David Braley spoke with Mr. Belfour and he does not want Mr. Dunham to return.  Mr. Belfour realizes that the Commission’s involvement will end if he does not allow Mr. Dunham to take corrective action to repair the well if so ordered by the Commission.

 

Findings: The Commission identified three potential issues: 1) Is a dropped liner and seals a violation of the Rules when required as a condition of Specialty Well approval? 2) Who installed the liner and seals? 3) Was the person who did the liner and seals installation licensed to perform this work at the time it was completed?

 

Information is needed from Trevor Gould, H2O Water, describing what he did for work on Mr. Balfour’s well.

 

Marc Loiselle made a motion to table the case until more information is received.  Ike Goodwin 2nd the motion.  Passed

 

     Judith (Scotty) Folger vs Carmel Well Drilling Inc:  Carmel Well Drilling submitted the information requested.  The Commission now is waiting for the results of the water test. On Hold

 

     Sandy Forde vs D & M Well Drilling Inc:  On hold waiting for water test results.

 

     John Doe vs Woodsome Well Drilling Inc: Dan Woodsome explained what he did with the well.  Mr. Doe doesn’t want to continue with hydrofracting the well or drilling deeper.  The well is not giving an ample amount of water.

 

     Mr. Woodsome has not taken any money for the well with no water. 

 

     Ike Goodwin made a motion and found no violation with the Well Driller and Pump Installer Rules. 

 

 

Specialty Well Applications:

 

     Barbara Johnson – E.A. Cross & Sons:  45 feet from neighbors leachfield and 20 feet from pump tank.  Approved with 120 feet of casing or liner, with bottom and top Jaswell Type seals.

 

Exams requested:

 

     Bert Deschaine, request to sit for the Journeyman Well Driller and Journeyman Pump Installer exams. Denied due to incomplete forms.  One reference must be from a Master Well Driller and Master Pump Installer. Please resubmit new form.  Rule 200.2

 

     Gary Deschaine,  request to sit for the Journeyman Well Driller and Journeyman Pump Installer exams.  Denied due to incomplete forms.  One reference must be from a Master Well Driller and Master Pump Installer.  Please resubmit new form. Rule 200.2

 

     Michael S Hickey, request to sit for the Master Well Driller Exam.  Michael Hickey Well Drilling, Sanbornville NH.  Accepted by the Commission to sit for the exam.

         

Examinations Passed:

 

James Hair, Ted McLeod III, Clifford Doughty,  Ted McLeod Well Drilling Inc.  All passed the Journeyman Well Driller and Journeyman Pump Installer Exam. 

 

New Bussiness

 

     Second Notice”

The new exam applications have been accepted by the Commission.  They will replace the old applications.
