The next Commission meeting will be held on Tuesday, September 4, 2007 at 9:00 A.M., but NOT at the Maine Motor Transport, Whitten Road, Augusta, ME.  Instead, the meeting will be held at 244 Water Street, Augusta. This is the building next to the Key Bank building.

Minutes of August 7, 2007 Meeting

Call to Order:

 

Meeting was called to order at 9:05 AM.

 

Approval of July 10, 2007 meeting minutes:

 

The Commission made a motion to approve the July 10, 2007 minutes with one correction.   Passed.

 

Up Date on Sheriffs Contract:

 

Approved and ready to implement. There are five agents through out the state. ID’s will be issued.

 

New Complaints:

 

     Carla Nixon vs Goodwin Well & Water Inc  (Ike Goodwin recused himself)  Problem is Ms. Nixon feels a spite well was drilled on her neighbor’s property.  Therefore, making it impossible for her to buy and develop the adjacent property owned by Ms. Lois Barter.

 

     Dan Camire, (the driller for Goodwin’s) selected the best place to drill the replacement well, which was 91 feet to the new on-site septic system and approximately the same distance from a cesspool on the Barter property. No permit had been issued for a septic system on the Barter property at that time, and has not been issued to date.

    

Dan Barter, (the homeowner’s son) stated that a septic area was staked out at the time of drilling.  They feel that the well had been drilled in order to impact the development of his mother’s property.  Mr. Barter would like a release form required by the Subsurface Disposal Rules for setback reductions of less than 60 feet signed by Mr. & Mrs. Kressbach, the people for whom the well had been drilled.

 

The Kressbach’s, are residents of the property on which the new well had been drilled. A new septic system required a new well be drilled and modifications to the original permit are being processed at the State level.  Lee Kressbach spoke with Carla Nixon explaining what they were doing on their property, including the abandonment of their existing well and the drilling of a new well.  Because of it’s location, the old well had to be abandoned before the new well could be drilled.  Ms. Nixon, who was in the process of buying the Barter property, attempted to acquire permit for a new disposal system very near the property line between these two sites, which would have made drilling a well on the Kressbach’s property impossible. Because the permit required State approval, no permit was ever granted.   

 

Ike Goodwin, explained that they did nothing to cause conflict with Ms. Nixon buying the property from Ms. Barter. In fact the new well they drilled for the Kressbach’s is further away then the old one they abandon.  There is room for Ms. Nixon to install a septic system and a well if she chooses to buy the property from Ms. Barter.  

 

The Commission listened to and questioned all involved.  Don Robbins made a motion, no evidence that a well construction complaint exist, therefore, no violation was found.  Glenn Dyer 2nd the motion.  Passed - Closed

 

Update on Appeals:

 

Wells Unlimited - Doug Wright:  Paul received the final order from the Commissioner and will forward it to David Braley. The Commission will adjust the points assessed and reorder the required corrective action.  Marc Loiselle made a motion for David to pursue action using the time allowed for corrective action in the original order. Dean Getchell will be on site when the alterations are made to the well.  Ike Goodwin 2nd the motion.  Passed

 

Rachel Charette vs Kevin Levesque Well Drilling: An appeal between the two parties is still in the Superior Court process.

 

Update on Complaints: 

 

The Attorney General is in process of sending a letter to a number individuals.   An advertisement which states “Well Points and Water Pumps” was provided to the Commission.  This firm/person is not licensed to do either.  The Well Drillers Commission licenses and regulates individuals and companies that install pump systems and well points.

 

Scott Temple apparently bought Fred Perry and Daughters Well Drilling:

 

David Braley will draft a letter inquiring about who the Master or Journeyman Well Driller is for the new rig and to update the Company licenses for the Commission’s records.

 

Douglas & Brenda Adams vs Bill Knowlton Well Drilling: 

 

David Braley made a motion to contact the CEO of the town and will cc Russell Martin, of the Subsurface Wastewater

Program, to remind them that the old well must be properly abandoned prior to the installation of the gray water system.  Glenn Dyer 2nd the motion.  Passed - Closed

 

Don Fries vs Woodsome Well Drilling:  On hold pending the results of the water test.

 

Cecil Fogg vs Bill Knowlton Well Drilling: The deadline for corrective action was July 16, 2007, nothing has been done. 

 

Marc Loiselle made a motion, Mr. Knowlton is in violation of corrective action ordered on well #2.  Mr. Knowlton’s drillers license and company license is suspended effective immediately with the exception of performing the repairs to Mr. Fogg’s well.  Mr. Knowlton’s licenses will remain in suspension until Dean Getchell has the opportunity to inspect the well during supervision of corrective action.  Letter to be delivered by the sheriff.  Glenn Dyer 2nd the motion.  Passed

 

Douglas Belfour – Merl “Sam” Dunham Well Drilling:  Closed

 

     Sandy Forde vs D & M Well Drilling Inc:  Glenn Dyer recused from voting.

 

     Dean Getchell’s report and video showed iron staining immediately under the casing caused by water entering under the casing seal. A copy of the video will be sent to D & M Well Drilling, Inc.

 

     The Commission found a violation of Rule 401.5, Failure to install a proper length of casing or liner and/or to affect a proper casing seal. Five points will be accessed. 

 

     Corrective action: To install appropriate seals into bedrock to prevent shallow groundwater and surface water from entering the well. Dean Getchell will inspect after corrective action is completed.

    

     Joanne Black vs Gary Adams Well Drilling:  No amount of water was guaranteed in drilling this well.  Ike Goodwin made a motion no violation of the Well Driller & Pump Installers Rule was found.  Marc Loiselle 2nd the motion.  Passed - Closed

 

Specialty Well Applications:

 

Lawrence Hobel – C & R Well Drilling Inc: 

 

42 feet from leach field and 75 feet from neighbor’s septic tank.    Approved

 

PROPOSED WELL TO HAVE 6 INCH STEEL CASING SEALED INTO BEDROCK TO A DEPTH JUST ABOVE THE FIRST FRESH WATER BEARING FRACTURE, WITH A MINIMUM OF 20 FEET OF CASING.  AS AN ALTERNATIVE, A MINIMUN OF 20 FEET OF 6 INCH STEEL CASING SHALL BE SEALED INTO BEDROCK WITH A SOLID 4 INCH LINER INSTALLED WITH TOP AND BOTTOM JASWELL TYPE STEEL CORE SEALS WITH THE BOTTOM SEAL JUST ABOVE THE FRESH WATER FRACTURE AND TOP SEAL UP INSIDE THE 6 INCH STEEL WELL CASING.  BOTH TOP AND BOTTOM SEALS SHALL BE WATER TIGHT.

 

     Sertha L Cosgrove – Delwin Philbrick Well Drilling Inc:

 

35 feet to disposal chambers on property. .
