MAINE WATER WELL DRILLING COMMISSION

 

Minutes of April 3, 2007 Meeting

Call to Order:

 

Meeting was called to order at 9:05 AM.

 

Approval of March 6, 2007 meeting minutes:

 

Corrections were made to wording, changing “ground water” to “surface water” in the Rodney Damon complaint description and added that Dan Woodsome did not appeal and paid the fines the Commission had ordered for the two complaints against Woodsome Well Drilling. Glenn Dyer made the motion and Marc Loiselle 2nd it to approve the minutes as amended. 

 

Up Date on Sheriff:

 

David Braley has spoken with Bob Howe, come to an agreement on payment methods for services. The contract is in the final stages of the review and approval process and should take effect in the very near future. 

 

Update on Appeals:

 

Doug Wright,s appeal is scheduled for April 30, 2007 at the DHHS Building in Portland. 

 

Woodsome Well Drilling did not appeal the findings by the Commission and paid the fines.

 

Kenneth Venoit vs Kennebec Well Drilling:  Mr. Venoit’s attorney, Mr. Newell Augur, requested that the Commission reconsider its decision to not act further until and unless the responsibility for the location of the second well is resolved.  He presented his case on the Commission’s ruling to not reconsider the decision.  The Commission’s conclusion to order the corrective action was discussed. Ike Goodwin made a motion not to reconsider the Commission’s rulings and David Braley 2nd the motion.  The pump has been removed from the second well and Kennebec Well Drilling will have 60 days from written notification to abandon the well as ordered previously by the Commission.  Passed

 

Update on Complaints:

 

Rachel Charette vs Kevin Levesque Well Drilling: The Commission is waiting for the Commissioner’s finial decision regarding an appeal.

 

Douglas & Brenda Adams vs Bill Knowlton Well Drilling:  Written notification on the abandonment of the old well is still required to complete the Commission’s order.       

 

Don Fries vs Woodsome Well Drilling:  Mr. Fries was given the 60 day extension he requested due to seasonal weather considerations.

 

     Rodney Damon vs Gerry Hill Well Drilling:  Closed

 

 

New Complaints: 

 

     Cheryl Oldfield vs Gary Adams Well Drilling: 

 

     The problem is sediment.  Mr. Adams drilled a second well for Ms. Oldfield.  Mr. Adams tried to fix the problem with a seal and it did not work.  Mr. Adams said he could not fix it do to bad health and offered the contractor a refund and the contractor refused to take a refund.  Mr. Adams was hired by the contractor and not Ms. Oldfield.

 

     Ike Goodwin made a motion to send Dean Getchell to inspect the well.  Marc Loiselle 2nd the motion.  Passed

 

     Cecil Fogg vs Bill Knowlton Well Drilling:

 

     The problem is mud and sediment.

    

Ed Bowie made a motion to send Dean Getchell to inspect the well.  David Braley 2nd the motion.  Passed

 

Specialty Well Applications:

 

     Scot Herman – James Philbrick Well Drilling Inc.  The proposed well is 20 feet from the holding tank and 80 feet from the leachfield.

 

     David Braley motioned for 90 feet of casing or liner. Ike Goodwin 2nd the motion Passed

 

Exams requested:

 

     Ricky Smart, Skilling’s & Sons, NH request to sit for the Master Well Driller exam.  Accepted by the Commission

 

     Dennis Bennett, Skilling’s & Sons NH, request to sit for the Master Well Driller exam.  Mr. Bennett showed 2½ years experience on his reference.  He is approved by the Commission to sit for the Journeyman Well Driller exam.  If he can show evidence of 3 years of well driller work he may sit for the Master Well Driller exam.

 

     Norman Skillings, Skilling’s & Sons, NH, request to sit for the Master Well Driller exam.  Accepted by the Commission.   

    

Examinations Passed:

 

Sean McCarthy, passed the Master Pump Installer exam, F X Lyons, Intervale NH.

 

Gary Schofield, passed the Master Pump Installer exam, F X Lyons, Intervale NH.

 

New Bussiness

 

     New Exam applications are going to request more information.  They will replace the old applications.

 

     The Commission has been invited to the Spring Demo in West Gardiner put on by MGWA.
