Call to Order:
Meeting
was called to order at 9:05 AM.
Approval of April
4, 2006 meeting minutes:
Glenn
Dyer made a motion to accept the minutes of the April 4, 2006 meeting with
corrections, Don Robbins 2nd the motion. The
required correction concerns the February minutes. E A Cross &
Sons request for a Specialty Well approval was mistakenly listed under
complaints. It should be noted that
there was not a complaint filed against them. Accepted by
the Commission.
Update on
Complaints:
Rachel Charette vs Kevin Levesque Well
Drilling: The Commission has
requested a letter of verification from Mr. Levesque concerning completion of
the Commission’s order. The Commission will send a second letter
to both the driller and the homeowner requesting the additional information.
Louise Scott vs L & L Well Drilling: Dean
Getchell submitted his inspection report.
According to the report the well is 61 feet from the septic tank and 67
feet from the leach field. There is
29 feet of casing installed in the well.
It appears that the well was drilled in the most reasonable location on
this property given the site’s limiting conditions and that a Specialty
well Application would likely have been approved if it had been submitted.
Findings: David Braley made a motion that
violations had occurred. Not enough casing was installed) and Rule 400.5
(Setback Reduction Notification Form was not submitted), Chris Olson
2nd it. Passed
Corrective action: David Braley made a motion and Ike
Goodwin 2nd it. In the
motion the Commission ordered Mr. Libby to submit an after-the-fact Setback
Reduction Notification Form and install Jazwell type seals and PVC sleeve with the
bottom seal at a minimum of 90 feet below grade and the top seal inside the casing,
above its termination. This corrective action must be completed within
60 days of receipt of the written order.
Passed
Findings: David Braley made a motion that additional
violations had occurred. Rule 200.1 (there must be a Master or Journeyman well
driller present at all times while the drill rig is in operation) and Rule
204.5 (everyone working near or on the drill rig must be licensed). The Commission is requesting the names
of all individuals working for L & L Well Drilling as well as their license
status. Chris Olson 2nd
the motion. Passed
The Commission further found
that Rock Libby has violated Section B-10 32 MRSA §4700-I of State
statute, Mr. Libby has employed unlicensed individuals to construct water wells
without supervision. Passed
Corrective action and penalties: David Braley made a motion
to order Mr. Libby to cease and desist.
The Commission also imposed a $1,000 fine and 15 day license suspension of
the Master Driller & Master Pump Installer licenses for Mr. Libby. The fine will be reduced to $500 and the
license suspension suspended completely if Mr. Libby successfully enters into a
consent agreement to be negotiated with Paul Gauvreau, the Commissions legal
council from the Office of Attorney General, which includes: a cease and desist
agreement concerning the use or employment
of unlicensed drillers and pump installers, a complete list of all employees of
L & L Well Drilling, an agreement that all employees of the company that
work on or near a drill rig are appropriately licensed with the Well Drillers
Commission prior to June 6, 2006 and the $500 fine is paid in full. Absent this agreement the full suspension
and fine will take effect June 6, 2006.

Barry Noyes vs
Findings: Ike Goodwin made a motion, in which the
Commission found
Corrective action: An after-the-fact Specialty Well Application
must be submitted along with a completed Setback Reduction Notification form. Passed.
Findings: The
well inspection shows the well responds to rainfall because of fractures just
below the casing allowing shallow ground water to be transmitted into the well.
Corrective action:
Ike Goodwin made a motion to have the driller place a bottom seal at 100
feet below the top of the well, 100 feet of PVC liner and a top
seal to be placed inside the casing. Don Robbins 2nd the
motion. Passed

Water Program vs E A Cross & Sons Well Drilling: Drilling a Public Water Supply without a New
Well Approval from the Drinking Water Program (DWP). David Braley made a motion
that the Commission finds a violation of Rule 401.2.1 (Public Water Supply
Wells) has occurred. A letter of
warning will be sent to the driller, Don Robbins 2nd the
motion. Passed.
The Drinking Water Program will deal with the public water supply New Well Approval
Application.
Drinking
Water Program vs B & D Well Drilling Inc: Drilling a Public Water Supply without a New
Well Approval from the DWP. Ike
Goodwin made a motion that B & D Well Drilling had
violated Rule 401.2.1 (Public Water Supply Wells). A letter of warning will be sent to the
driller, David Braley 2nd the motion. Passed.
Kenneth
Wood vs Forest Pump & Filter Co. Inc: A Specialty Well Application was required but not submitted for this well. The well is 48 feet from the septic tank
(less than the 60 feet required by regulation).
Findings:
David Braley motioned that a violation of Rule 400.5 (Setback
Reduction Notification form) and Rule 400.7 (Specialty Well Application) had occurred.
Corrective
action: The driller shall
install 125 feet of casing or liner with Jazwell type seals top and bottom. The driller must also submit an
after-the-fact Specialty Well Application and a completed Setback Reduction
Notification Form. All corrective
action must be completed within 60 days of written notification. Passed.
Kenneth
Beach vs Merl”Sam” Well Drilling Inc:
Problem is sediment in the water.
The problem is more noticeable after the well has sat unused for period
of time. The water test submitted shows
high iron and manganese. Waiting for the response from the driller. The Commission has requested a sample of
the filter and/or water from the home owner.
Dan
Staples vs Knowlton Well Drilling: Complaint is of a disposal
system designed over an existing well and questions concerning the location of
the new well relative to the septic system. The Commission questioned if the well was
properly abandoned in order to protect groundwater in the area. A letter will be sent the site evaluator
and the homeowner requesting additional information.
Peter
Haraden vs Burns Well Drilling: Problem is mud after hydrofracting. Waiting for
response from driller.
Specialty
Wells
David & Michelle Currier – Fred Perry & Daughters Inc:
Approved by Commission with 6 inch casing or Jazwell type liner seals, installed to the maximum depth possible above fresh water in order to prevent salt water intrusion. Terminate casing or set bottom seal just above the first fresh water fracture.
Richard & Michele D’Amelio – Fred Perry & Daughters Inc:
Approved by Commission with 6 inch casing or Jazwell type liner seals, installed to the maximum depth possible above fresh water in order to prevent salt water intrusion. Terminate casing or set bottom seal just above the first fresh water fracture.
Approved by Commission with 120 feet of 6 inch casing, installed inside a 10 inch annulus. Grouted from bottom to top with tremie method of placement. Dean Getchell will be on site during grouting.

Shawn Marston, Hodgdon Well Drilling is requesting to sit for the Journeyman Well Drilling exam. A motion was made and seconded. Approved by the
Commission.
Ben Faulkner, High Pine Well Drilling:
is requesting to sit for the Journeyman Well Drilling exam and the
Journeyman Pump Installer exam. Approved by the Commission.
Cynthia Staples, Western Maine Water Inc:
is requesting to sit for both Journeyman Well Driller and Journeyman
Pump Installer exams. Ike Goodwin
motioned to accept and Glenn Dyer 2nd. Approved by the
Commission.
New
Business:
David
Braley explained the re-organization of the Drinking Water Program and how it
may affect drillers.
Frank
Hagerty requested an application to sit for the Master Well Drillers exam.
