Minutes of March 7, 2006 Meeting

Call to Order:

 

Meeting was called to order at 9:05 AM.

 

Approval of February 7, 2006 meeting minutes:

 

Don Robbins Glenn Dyer made a motion to accept the minutes of the February 7, 2006 meeting, Glenn Dyer 2nd the motion.  Accepted by the Commission.

 

The “Violation Point System” was discussed in detail.  Members of the Maine Groundwater Association offered many comments and ideas and will meet in the near future to prepare a written proposal to the Commission for presentation at the next regular meeting.

 

Update on Complaints: 

 

Rachel Charette vs Kevin Levesque Well Drilling: Appeal Scheduled for Monday, March 20, 2006.

 

Ron Montgomery vs Hillock & Son Well Drilling: - On Hold,    waiting for response from Mr. Montgomery concerning pump system and contract price.

 

Louise Scott vs L & L Well Drilling:  Hold. Waiting for statements from Ms. Scott’s neighbors concerning who drilled the well.

 

Kathleen MacKenzie vs Adam Baker Well Drilling: Dean Getchell will contact both the driller and homeowner to set a time to inspect the well. The Commission cannot be involved with the financial issues.  Ms. MacKenzie should contact the Attorney General’s Office concerning the lack of a contract for this work. On hold for Dean’s report.

 

New Complaints:

 

Ronald Rowland, LPI vs Carmel Well Drilling:  Complaint is, well was drilled within 33’ of what would be the closest chamber in the to-be-installed system. Carmel Well Drilling has not, as of the February 20th date the well was drilled, renewed their licenses for the 2006 year.

 

     Glenn Dyer made a motion to turn the case over to the A G’s office with recommendation of a $500 fine due to drilling without a valid license. Marc Loiselle 2nd it.  Passed

 

     No violation of set back was found due to no paperwork on septic system on file with appropriate officials.

 

Daniel Ouellet vs R J Johnson Well Drilling (A & W Well Drilling):  Problem is low water flow, pump set at 400’ Pump cannot be lifted and no water flow. 

 

     Dean Getchell will inspect the well.  A standard Complaint letter will be sent to Alan Follett (A & W Well Drilling), Amos Carson (apprentice driller), F Martin Baker (well driller), R J Johnson Well Drilling).

Thomas Rouse vs Merl “Sam” Dunham Well Drilling Inc: - Closed

Specialty Wells

    

Pat Apt – Affordable Well Drilling Inc:  Approved with 120 feet of casing, 6 inch hole within 10inch annulus grouted from bottom to top with a tremie method. A letter will be sent to Ms. Apt notifying her of the risk.   Dean Getchell will be on site and inspect during drilling.

 

Examinations Requested

 

Ryan Ball, Hatch Well Drilling Inc, has requested to sit for the Journeyman Pump Installers Exam and the Journeyman Well Drillers Exam.

 

Glenn Dyer made a motion and Don Robbins 2nd it, to allow Mr. Ball to sit for the exams.  Motion accepted by the Commission.

 

Timothy D Williams, Weeks & Sons Well Drilling, has requested to sit for the Journeyman Pump Installer exam. 

 

Glenn Dyer made a motion and Don Robbins 2nd it, to allow Mr. Williams to sit for the exams.  Motion accepted by the Commission.

 

Ray Blackstone commented on requirements for sitting for the exam.  It was explained to him that experience earned before the effective date of the first rules was appropriate for consideration to sit for an exam and that he should prepare an application for the Commission to review.                

 

New Business: 

 

Southern Maine Pump Supply expressed a concern on Driven Point Wells.  After checking with the Attorney Generals Office, current verbiage in statute indicates that the Commission does regulate driven point wells. 

 

The Legislature would be the place to start to express concern and request the this be changed.

 

Point System:  The Commission has asked the Maine Ground Water Association for their input with the new system.
