The Underground Storage Tank Program within the Department of Environmental Protection’s Bureau of Remediation and Waste Management is dedicated to preventing leaks and spills from underground storage tanks. The program fulfills various functions to assist the public, tank owners, and tank installers and inspectors.

Underground Tank Enforcement

Underground Storage Tank Program staff are also responsible for enforcing the state’s statutes for underground oil storage facilities and ground water protection and DEP Rules for Underground Oil Storage Facilities, Chapter 691. Their duties include inspecting facilities for compliance, reviewing annual inspections and other facility information, notifying owners and operators of violations and providing technical assistance and outreach to tank owners and the public. Staff maintain an extensive database of registered underground oil storage facilities, and can provide guidance on how to operate a facility in compliance.

Underground Storage Tank Registration

Underground Storage Tank Program staff are also responsible for the review of registration materials submitted by the regulated community for the repair, upgrade, installation and removal of underground oil storage tanks and ancillary equipment. Staff review the registration documents to ensure the contents meet the requirements of Chapter 691 of the Department’s Rules for Underground Oil Storage Facilities. Staff also review proposed underground storage tank installations requiring site review under 38 M.R.S.A. Section 563-C.

Board of Underground Storage Tank Installers

The Board certifies underground oil tank installers, underground oil tank inspectors, and underground gasoline tank removers based on their knowledge of installation, inspection and removal practices. The Board also provides continuing education for certified persons and undertakes disciplinary action on certified persons when needed.

The Board’s office is located and maintained within the Maine Department of Environmental Protection (DEP), Bureau of Remediation and Waste Management. However, since the Board has its own enabling statute and rulemaking authority, it is an agency separate from DEP.

Technical Assistance

Underground Storage Tank Program staff are responsible for administering the technical aspects of the Department's Home Heating Oil Tank Replacement program and the state’s Spill Prevention Control and Countermeasure (SPCC) program, providing technical assistance to the UST program as well as general guidance to the public, UST and AST community, and other bureaus within the Department in the proper storage and handling of hazardous materials. Staff duties include the review of SPCC plans, applications relative to the UST siting law, investigations of UST facility leaks and UST/SPCC/hazardous materials technical assistance site visits.
