How to use this packet

This packet of materials is designed specifically for Code Enforcement Officers as an aid to get information out to contractors and homeowners who conduct home renovation/demolition activities that may impact over two square feet of lead based paint or more than 3 square or linear feet of asbestos containing material.

CEO’s generally meet face to face with contractors/homeowners seeking a permit to renovate or demolish a building in their town or city. The DEP feels this is a perfect opportunity to explain current state and federal laws which can greatly impact how such home activities are conducted in an environmentally safe manner.

Generally speaking the packet emphasizes two issues:

1. Contractors working in pre 1978 residential houses and apartments who may disturb more than two square feet of lead based paint are required to distribute to the owner or tenant a pamphlet titled Protect Your Family from Lead in Your Home before starting renovation work. This is based on the US EPA Lead- Based Paint Pre-Renovation Education Rule (406b). EPA is the agency that will enforce this rule. Violations are very costly. Renovation notification and pamphlet confirmation forms are included that you may freely copy and distribute as necessary.

2. State and federal laws require that buildings be inspected for asbestos containing materials (ACM) before renovation or demolition activities begin. To determine whether an inspection performed by a Maine licensed Asbestos Inspector, or an evaluation performed by a knowledgeable non-licensed individual familiar with ACM (e.g. building inspectors and CEO’s who have asbestos awareness training) depends on the age of the building, current/past use, and number of units. A checklist is included to determine whether a renovation/demolition project requires an inspection by a state asbestos inspector. If so additional notification forms and general guidance information is included which can be copied and provided to the contractor/renovator.
