Intent to Renew DEP General Permit - Application of Piscicides For the Control Of Invasive Fishes and Anti-Fouling Paint Contaminated Vessel Wash Water

Please take notice that, pursuant to 38 M.R.S. §§ 413 and 414-A, 06-096 CMR 2 and 06096 CMR 529, the Maine Department of Environmental Protection (Department) intends to renew two General Permit's (GP), #MEG180000, Application of Piscicides for the Control of Invasive Fishes (which was issued on August 29, 2014 for a five-year term) and #MEG170000 Anti-fouling Paint Contaminated Vessel Wash Water (which was issued on October 14, 2014 for a five-year term). Coverage under the General Permits is contingent upon Department acceptance of a Notice of Intent (NOI) form from each applicant. The General Permits will be issued for a five-year term, respectively.

The Anti-fouling Paint Contaminated Vessel Wash Water GP conditions discharges of wash water resulting from washing vessels coated with antifouling paint to Class SB or SC waters in accordance with the stipulations of the General Permit.

The Application of Piscicides for the Control of Invasive Fishes GP authorizes discharges of aquatic piscicides to Class GPA, AA, A, B and C waters of the State, tributaries to Class GPA waters, and those waters having drainage areas of less than ten square miles, that contain populations of invasive fishes.

The Department has not scheduled a public hearing on the proposed draft modification to the General Permit. Persons wishing to request a public hearing or wishing to request that the Board of Environmental Protection (BEP) assume jurisdiction over the modification of the General Permit may do so during the 30-day public comment period. Requests must state the nature of the issues(s) to be raised. Any correspondence must include the commenter's name, and affiliation if representing an organization.

Only those conditions to be modified are reopened for consideration. All other aspects of the existing General Permit remain in effect.
