The Maine Board of Environmental Protection (BEP) adopted Chapter 532 on April 21, 2005. The rules took effect on May 25, 2005
The Maine DEP was required to adopt routine technical rules to implement certain requirements contained in what is commonly referred to as the "federal Alaska Law".(1) Routine technical rules do not require legislative review. The "federal Alaska Law" is made up of federal statutes and rules that are implemented by the U.S. Coast Guard in certain waters of Alaska.
Comment deadline was 5:00 p.m., January 5, 2005. Formal comment was received prior to comment deadline from: Antonio Blasi (Hancock Point Kayak Tours); Shep Erhart (Maine Coast Sea Vegatables, Inc.); Ivy Main; Michael McGiffert; Renata Moise; Ted Thompson page one, and page two (International Council of Cruise Lines).
Persons who formally commented on this rule during the comment period may provide additional comment at the adoption meeting, if certain requirements are met. This is explained in Guidance on Public Comment at Time of Rule Adoption.

(1) This requirement is contained in PL 2003, Chapter 650, "An Act to Protect Maine's Coastal Waters".
Public comments were solicited on an informal draft between July 21 and September 9, 2004. A public information meeting (pre-posting) on the draft rule was held on September 1. Two people attended to listen, but not to offer comments. See History for more information.
The attached timeline was made available at the public information meeting, together with information already available in some form on this website.
Staff received permission from the Board of Environmental Protection (BEP) to post revised draft rules to public comment (without a hearing) on November 4, 2004. The publication date for the newspaper notice on these rules was November 17. Comment deadline was 5:00 p.m., January 5, 2005.
